CIPSEA overrides EIA's obligation to share data
EIA has a statutory obligation to share data with other federal agencies under 15 U.S.C. §771(f) and with any organizational unit within the U.S. Department of Energy under 42 U.S.C. §7135 (f).
However, Section 3564(d) of the CIPSEA statute overrides EIA's statutory obligations to share information with other agencies in the executive branch. Section 3572(b) of the CIPSEA statute states that CIPSEA-protected information shall be used exclusively for statistical purposes. Because CIPSEA prohibits the nonstatistical use of CIPSEA-protected data, CIPSEA data may not be shared with other federal agencies for regulatory, enforcement, administrative, investigative, or any other nonstatistical purposes.
